Recent regulatory changes announced by Chairman Paul Atkins of the SEC and Chairman Michael Selig of the CFTC mean that projects can resume implementation of their token economies. Vault12, the pioneer of crypto inheritance provided critical feedback to the SEC in 2025, on how its token was intended to be used, now with new regulations in place, Vault12 can complete introduction of its full token economy as described in its white paper. The big picture
May was a pivotal month for the rules that will shape how — and where — your crypto can be held, transferred, and ultimately passed on. The US edged closer to settling its longest-running regulatory fight, the UK opened the door to firms preparing for authorization, and the EU started asking whether its own landmark framework still fits the market it created. Here’s what mattered.
United States: market structure clears a major hurdle
The CLARITY Act advanced out of committee. On May 14, the Senate Banking Committee passed the Digital Asset Clarity Act by a 15–9 vote, sending it to the Senate floor. At its heart is the question that has dogged the industry for years: which assets are securities (SEC) and which are commodities (CFTC). The bill answers it with a decentralization threshold — once a network is sufficiently decentralized, its token moves from the SEC’s securities regime into the CFTC’s commodity framework. Markets read it as a turning point, with Bitcoin and crypto-linked equities rallying on the news. (Yahoo Finance, Mudrex)
The CFTC opened the door to regulated perps. On May 29, the CFTC approved Kalshi to list BTCPERP — the first true bitcoin-referenced perpetual futures contract at a US-regulated venue — and issued a same-day no-action letter to Coinbase. In parallel, the SEC is preparing a broad “innovation exemption” from Chairman Atkins designed to let tokenization of securities move forward under temporary registration relief while Congress finishes its work. GENIUS Act stablecoin rules moved through comment. The OCC’s proposed rules for payment stablecoin issuers reached the end of their public comment window on May 1. Mid-month, banking trade groups pressed lawmakers (statements on May 4 and May 8) to tighten stablecoin yield guardrails, warning that unchecked yield could pull deposits out of the traditional banking system. United Kingdom: the authorization runway opens
Pre-application meetings began. From May 11, the FCA’s PASS service started accepting requests from crypto firms wanting a pre-application meeting — the first practical step toward authorization. The authorization gateway itself opens on September 30, 2026, with the full regime expected to take effect on October 25, 2027. (FCA)
Readiness webinars continued. The FCA ran an operational resilience session on May 21 as part of its rolling series to help firms prepare, with policy statements due this summer and DeFi guidance to follow later in the year. (FCA consultation)
European Union: MiCA goes under its own microscope
The Commission launched a MiCA review. On May 20, the European Commission opened both a public and a targeted consultation on the functioning of the Markets in Crypto-Assets Regulation, each running until August 31, 2026. The message: as the market and policy landscape expand, regulators want to know whether the 2024 framework is still fit for purpose. (European Commission, PYMNTS)
The transitional clock is running out. The review arrives just ahead of a hard deadline — the EU-wide MiCA transitional period ends July 1, 2026, after which firms can no longer rely on grandfathering to operate without authorization. Notably, several of the most widely held stablecoins (including USDT, DAI, USDe, FDUSD, PYUSD, and TUSD) remain without MiCA authorization as of May. (Hacken, eco.com stablecoin list)
Why this matters for inheritance
Every one of these moves tightens the regulatory perimeter around where your assets live — which exchange will list a token, which stablecoin you can legally hold, which venue can custody your funds. With roughly 70 million Americans now owning crypto and Bitcoin the most widely held asset among them (Ironclad Family), the gap between owningcrypto and having a plan to pass it on has never been wider.
Regulation can clarify who oversees the market. It can’t recover a seed phrase no one in your family knows exists.
